1.2 "Services" refers to the services provided by kalebrock.com to users, including but not limited to the sale and delivery of goods, customer support, and any additional features or functionalities provided.
1.3 "Goods" refers to any products or items offered for sale on kalebrock.com.
1.4 "User" refers to any person or entity accessing or using kalebrock.com.au for any purpose.
2. Eligibility
2.1 By using our website, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into a binding agreement.
3. Orders and Purchases
3.1 When placing an order for goods or services on kalebrock.com.au, you agree to provide accurate, complete, and up-to-date information. You are solely responsible for the accuracy of the information provided.
3.2 All orders are subject to acceptance by kalebrock.com.au. We reserve the right to refuse or cancel any order at any time for any reason.
3.3 Prices displayed on kalebrock.com.au are in the currency specified for our region (Australia). Additional charges, such as taxes, shipping fees, or customs duties, may apply when shipping internationally.
4. Refunds (Updated February, 2024).
4.1 Refunds for any domestic services and retreats (taking place in Australia only). our cancellation policy is as follows:
In the event that you require to cancel your attendance at the retreat, we will operate a concert ticket policy where you will be responsible to re-sell your spot if you are no longer able to attend. In the event this spot is not sold, we will not be able to issue any refund or credit.
Please note that kalebrock.com is not required or responsible for finding a replacement for your retreat spot. For retreat experiences where a deposit is taken, you will be required to pay the full amount of the retreat 120 days prior to the commencement date, failure to pay the remaining amount within 100 days will result in a forfeiting of your place and deposit.
4.2 Refunds for any international service or retreat (taking place outside Australia only), our cancellation policy is as follows:
Our surf experiences are strictly non refundable.
As such, we strongly recommend you purchase comprehensive travel insurance to protect you should you need to cancel. Deposits are non refundable and final payments are non refundable.
This is because we commit this equity to securing locations and the heavy administrative duties involved in organising these experiences. In most cases, you are able to sell/transfer your place on an experience to another person, at your own cost. If there are external circumstances out of our control which prevent us from running the experience (natural disaster, pandemic travel restrictions, political upheaval, war etc) we will offer you a credit on the experience to use at a later date.
For retreats where a deposit is taken, you will be required to pay the full amount of the retreat 120 days prior to the commencement date, failure to pay the remaining amount within 100 days will result in a forfeiting of your place and deposit.
4.3 All services / surf retreats will require you to provide further information upon purchase including a waiver signature. In the case you do not sign this waiver or provide necessary information in the specified timeframe, and are unable to participate as a result, kalebrock.com will not be required to provide a refund.
4.4 Refunds on physical goods: If the product you received is defective, damaged, or faulty, you may be eligible for a refund. We define faulty goods as products that have a manufacturing defect or arrive in a damaged condition that significantly affects their functionality.
4.4.1 Eligibility: To be eligible for a refund due to faulty goods, please ensure that:
You contact our customer support team within 14 days of receiving the item via hello (at) kalebrock (dot) com (dot) au or the contact form on this website.
You provide proof of purchase, such as the order number, invoice, or receipt.
The product is unused, in its original packaging, and in the same condition as when you received it.
4.4.2 Return Process: If you believe you have received a faulty product, please follow these steps:
Contact our customer support team at hello@kalebrock.com.au within 14 days of receiving the item to initiate the return process.
Provide detailed information about the fault or damage, along with any supporting evidence such as photographs, if applicable.
Our customer support team will guide you through the return process, which may include providing you with a return shipping label or arranging for the collection of the faulty item.
4.4.3 Refund Options: Depending on the circumstances and your preference, we may offer the following refund options:
Refund to the original payment method: The refund amount will be credited back to the same payment method used during the purchase. *Transaction fees may apply.
Credit: If you prefer, we can provide you with a store credit equivalent to the refund amount, which can be used for future purchases on our website.
4.4.4 Exclusions: Our refund policy applies specifically to faulty goods. Please note that we do not offer refunds for the following scenarios:
Change of mind or personal preference.
Damage caused by improper use, mishandling, or neglect.
Normal wear and tear or minor cosmetic imperfections that do not affect the functionality of the product.
Additional Information:
We reserve the right to assess the condition of the returned item before approving a refund.
Refunds may take 30 business days to process, depending on your payment provider.
Shipping and handling fees are non-refundable unless the fault or damage was a result of our error.
5. Intellectual Property
5.1 The content, design, and logos on kalebrock.com.au are protected by intellectual property laws and are the property of kalebrock.com.au or its licensors. You are granted a limited, non-transferable, and non-exclusive license to access and use kalebrock.com.au for personal and non-commercial purposes.
